DMCA Policy

BAM NFT respects intellectual-property rights and expects every user and Merchant on the Service to do the same. We respond to clear notices of alleged copyright infringement that comply with the United States Digital Millennium Copyright Act (DMCA) and the equivalent take-down procedures of EU and Norwegian law.
1. Reporting infringement
If you believe content listed, minted, or displayed on https://bamnft.com infringes a copyright you own or are authorised to enforce, send a written notice to help@bamnft.com with the subject line “DMCA Notice”. To be actionable your notice must include all of the following:
- A physical or electronic signature of the rights-holder or a person authorised to act on their behalf.
- Identification of the copyrighted work claimed to have been infringed (or, for a multi-work claim, a representative list).
- The exact URL on https://bamnft.com, the on-chain token ID, contract address, or other identifier that allows us to locate the allegedly infringing material.
- Contact information for the complainant: full legal name, mailing address, telephone number, and email address.
- A statement that you have a good-faith belief that the use of the material is not authorised by the copyright owner, its agent, or the law.
- A statement, under penalty of perjury, that the information in the notice is accurate and that you are the rights-holder or authorised to act on its behalf.
Incomplete notices may be ignored or returned to you with a request to supply the missing information.
2. What we do
On receipt of a complete notice we will, in our sole discretion and as quickly as commercially reasonable:
- remove or disable access to the listing, page, or off-chain metadata that hosts the allegedly infringing material;
- notify the Merchant or user that posted the material that we have received a notice and that their material has been removed;
- forward the notice (with personally-identifying information redacted only where law permits) to the affected Merchant.
On-chain tokens, by their nature, cannot be deleted; the underlying blockchain record will persist. What we can remove is our hosted metadata, our storefront listing, and any references to the work from the parts of the Service we control.
3. Counter-notification
If material you posted has been removed and you believe the removal was a mistake or misidentification, you may send a counter-notice to help@bamnft.com containing:
- your physical or electronic signature;
- identification of the material that was removed and the URL or on-chain identifier where it had appeared before removal;
- a statement under penalty of perjury that you have a good-faith belief the material was removed as a result of mistake or misidentification;
- your full legal name, address, and telephone number, together with consent to the jurisdiction of the courts of Norway (or, if you are outside Norway, the jurisdiction where the original notice was served).
On receipt of a valid counter-notice we will forward it to the original complainant. Unless the complainant notifies us within ten business days that they have filed a court action seeking a restraining order against the affected user, we may restore the material at our discretion.
4. Repeat infringers
We will, in appropriate circumstances, suspend or terminate the accounts and Merchant storefronts of users who repeatedly upload material that has been the subject of valid take-down notices. What counts as “repeat” is judged on the totality of the complaints we have received and is at our reasonable discretion.
5. Misuse
Submitting a notice or counter-notice that misrepresents material as infringing, or as having been removed in error, may expose you to liability for damages — including costs and legal fees — under the DMCA and equivalent national laws. Don’t do that.
