DMCA Policy

BAM NFT respects intellectual-property rights and expects every user and Merchant on the Service to do the same. We respond to clear notices of alleged copyright infringement that comply with the United States Digital Millennium Copyright Act (DMCA) and the equivalent take-down procedures of EU and Norwegian law.

1. Reporting infringement

If you believe content listed, minted, or displayed on https://bamnft.com infringes a copyright you own or are authorised to enforce, send a written notice to help@bamnft.com with the subject line “DMCA Notice”. To be actionable your notice must include all of the following:

Incomplete notices may be ignored or returned to you with a request to supply the missing information.

2. What we do

On receipt of a complete notice we will, in our sole discretion and as quickly as commercially reasonable:

On-chain tokens, by their nature, cannot be deleted; the underlying blockchain record will persist. What we can remove is our hosted metadata, our storefront listing, and any references to the work from the parts of the Service we control.

3. Counter-notification

If material you posted has been removed and you believe the removal was a mistake or misidentification, you may send a counter-notice to help@bamnft.com containing:

On receipt of a valid counter-notice we will forward it to the original complainant. Unless the complainant notifies us within ten business days that they have filed a court action seeking a restraining order against the affected user, we may restore the material at our discretion.

4. Repeat infringers

We will, in appropriate circumstances, suspend or terminate the accounts and Merchant storefronts of users who repeatedly upload material that has been the subject of valid take-down notices. What counts as “repeat” is judged on the totality of the complaints we have received and is at our reasonable discretion.

5. Misuse

Submitting a notice or counter-notice that misrepresents material as infringing, or as having been removed in error, may expose you to liability for damages — including costs and legal fees — under the DMCA and equivalent national laws. Don’t do that.
